RULES FOR THE SALE AND USE OF YARMICH GIFT CERTIFICATES

These Rules are effective from February 20, 2024.

These Rules define the terms and conditions for the sale and use of gift certificates in the YARMICH boutique network and on the Yarmich.store website.

Definitions

Gift Certificate (hereinafter – the Certificate) – a physical medium made of thick A5 cardboard and/or presented in an individual gift box, has a serial number, expiration date, and confirms the holder’s right to purchase goods only in YARMICH boutiques within the value indicated upon purchase. The Certificate grants its holder the right to purchase goods available on the date of redemption and at the prices valid at the time of purchase. 

Certificate Nominal Value – the face value of the Certificate indicated on it at the time of purchase, which limits the maximum value of goods that can be obtained by the holder in YARMICH boutiques.

Seller – the YARMICH boutique network, Yarmich.store website, represented by business entities that hold the exclusive right to use the YARMICH trademark and are the owners of the Certificates.

Buyer – a natural person who has purchased a Certificate from the Seller, owns it, and has the right to claim under it. The Buyer may transfer the Certificate to third parties. The Buyer is obliged to inform such third parties about the expiration date and the terms of these Rules. The Seller does not verify the legitimacy of goods redemption by third parties. When transferring the Certificate to third parties, the Buyer must inform them about the validity period and the terms of these “RULES FOR THE SALE AND USE OF YARMICH GIFT CERTIFICATES.”

Holder – any third party presenting the Certificate to purchase goods.

Certificate Validity Period – the period during which the holder has the right to present the Certificate to receive goods within its nominal value in YARMICH boutiques.


1. TERMS OF PURCHASING A CERTIFICATE.

1.1. The Certificate can be purchased in cash or by non-cash payment at YARMICH boutiques or by placing an online order on Yarmich.store.

1.2. By purchasing the Certificate and/or using it for payment, the holder confirms that they have read and agree to these Rules.

1.3. When purchasing a Certificate, the Buyer pays a monetary amount that determines its nominal value, indicated by the Seller on the Certificate itself, which serves as a deposit credited toward payment for future goods to be purchased by the holder.

1.4. The Certificate can be used only during one or several purchase transactions (per one receipt) from the Seller.

1.5. When purchasing goods with a Certificate, the physical Certificate is retained by the Seller’s stylist during the in-store transaction and rendered invalid for further use.

1.6. If the purchase amount exceeds the nominal value of the Gift Certificate, the Holder must pay the difference between the product price and the nominal value. The difference can be paid by card or in cash in the store.

1.7. If the purchase amount is less than the nominal value of the Gift Certificate, the difference between the price and the nominal value is not refunded in any form, but the remaining balance may be used for future purchases within the validity period of the Certificate.

1.8. The Seller’s obligations under the Gift Certificate are limited by the validity period, the available product assortment, the nominal value of the Certificate, the store’s operating hours, and other conditions of these Rules.


2. CERTIFICATE VALIDITY PERIOD 

2.1. The validity period of the Certificate is limited and indicated on it at the time of purchase.

2.2. The Certificate may specify one of two validity formats:

until the date (inclusive) indicated on the Certificate — up to DD.MM.YYYY;

for a period (in days) indicated on the Certificate from the date of purchase.

2.3. If the Certificate holder does not redeem it for goods within the validity period, the Seller’s obligations under the Certificate are considered fulfilled, and the amount paid for the Certificate is non-refundable and remains with the Seller.

2.4. The validity period of the Certificate cannot be changed, extended, or renewed.


3. RETURN OF THE GIFT CERTIFICATE

3.1. The Certificate is non-refundable, non-exchangeable for another denomination, and cannot be converted back into cash.

3.2. In case of a return of goods purchased using a Certificate in accordance with the Law of Ukraine “On Consumer Protection,” the Buyer is not refunded in cash. The goods may be exchanged for other available goods or a new gift certificate of equivalent value may be issued.


4. OTHER PROVISIONS.

4.1. The Seller reserves the right to amend or supplement these Rules.

4.2. Any amendments or supplements to these Rules do not require prior approval from the Buyer/Holder.

4.3. The Seller informs about changes or additions to these Rules by publishing them on the Yarmich.store website.

4.4. These Rules for the use of the gift certificate constitute an adhesion contract under Article 634 of the Civil Code of Ukraine. Such a contract may only be concluded by one party’s full acceptance of the proposed terms. By purchasing the Certificate or using it for payment, the Buyer/Holder confirms that they have read and agree to these Rules. 

4.5. The Seller of the gift certificate is released from the obligation to provide goods for a lost (damaged) Certificate or to refund the amount paid for such a Certificate, and is not liable for refusal to provide goods or refund money in the event of loss or damage of the Certificate.

4.6. The Seller of the Certificate is not responsible for the consequences of loss or transfer of the Certificate by the Buyer to a third party.

4.7. A lost (damaged) Certificate cannot be restored.

4.8. The Seller has the right to refuse acceptance of a gift certificate if there are doubts about its authenticity and/or it is damaged.

4.9. The risk of accidental loss, damage, or destruction of the gift certificate passes to the Buyer/Holder from the moment of purchase.
